Terms of Service

The agreement between you and us: what we provide, what we ask of you, and how either side can end it.

Effective · MyEasyBase Technology Inc., Vancouver, BC

These terms are the agreement between you and MyEasyBase Technology Inc. for the websites, domains, hosting and related services you buy from us. By opening an account or placing an order, you accept them.

If you are agreeing on behalf of a company, you confirm you are allowed to bind that company.

Your account

You need an account to buy from us. You are responsible for keeping its credentials safe and for everything done through it.

Tell us promptly if you think someone else has access. We strongly recommend turning on two-factor authentication — it is free, it takes two minutes, and it is the single most effective thing you can do to protect the account.

We will never ask you for your password. Anyone who does is not us.

Services, pricing and renewals

Prices are shown in Canadian dollars and exclude sales tax, which is added at checkout based on your billing province.

Services renew automatically at the price shown on your invoice, on the renewal date shown in your client area, unless you cancel first. We email a reminder 30 days, 7 days and 1 day before a renewal. You can turn auto-renew off for any service at any time.

We may change prices, but never mid-term: a change applies from your next renewal, and we will give you at least 30 days' notice.

Refunds

Hosting carries a 30-day money-back guarantee from a first purchase. After that, unused time on an annual plan is credited to your account rather than refunded.

Domain registrations, renewals and transfers cannot be refunded. The registry fee is spent the moment a registration is filed and no registrar can recover it. Please check the spelling before you buy — this is the one purchase with no undo.

Website design work is refundable until we begin design; after that it is not, because the work has been done.

Acceptable use

You may not use our services to:

  • Break Canadian law, or the law where your visitors are.
  • Send unsolicited bulk email, or host anything that supports it.
  • Distribute malware, run phishing pages, or attack other systems.
  • Publish material you have no right to publish, including infringing copies of other people's work.
  • Host content that is illegal to possess or distribute.
  • Consume shared resources in a way that degrades the service for other customers on the same server.

We investigate abuse reports. Where something is clearly illegal or actively harming others, we may act immediately; otherwise we contact you first and give you a reasonable chance to fix it.

Your content

What you publish is yours. We claim no ownership of your website, your data or your files.

You grant us only the permission we need to run the service — to store, copy and transmit your content in order to host and back it up. That permission ends when your account does.

You are responsible for having the rights to everything you publish, and for making sure it complies with the law and with these terms.

Domain registrations

Domains are registered through registries whose rules we do not control. Registering one makes you subject to that registry's policies, including ICANN's for generic extensions and CIRA's Canadian Presence Requirements for .ca.

You are the registrant. We act as your registrar and will not transfer, sell or surrender a domain without your instruction, except where a registry, a court or a dispute-resolution decision requires it.

Keep the contact email on your domains current. Registry notices — including expiry warnings — go there, and a domain lost to an unread mailbox is very difficult to recover.

Backups

We take daily backups of hosting accounts and keep them for 30 days, and we test restores. That is a safety net, not a substitute for your own copies.

Please keep your own backups of anything you cannot afford to lose. We will always try to help, but we cannot guarantee that a particular backup will exist or be usable at a particular moment.

Availability and support

We target 99.9% availability, measured monthly, excluding announced maintenance. Planned maintenance is announced in advance whenever the work allows it.

Support is available every day of the year by ticket, and by chat when you are signed in. We do not guarantee a resolution time — some problems belong to registries, upstream networks or other providers — but we do commit to responding, and to telling you honestly when something is outside our control.

Suspension and termination

You may cancel any service at any time from your client area, effective immediately or at the end of the current term.

We may suspend or terminate a service if payment fails and stays unpaid after our reminders, if these terms are breached, or if we are legally required to. Except where the law or an immediate risk to others requires otherwise, we will contact you first.

When an account closes we keep your data for 90 days in case you return, then delete it. Move your domains and take a backup before that window closes.

Liability

We provide the services with reasonable skill and care, but we cannot promise they will be uninterrupted or error-free.

To the extent the law allows, our total liability for any claim relating to a service is limited to what you paid us for that service in the twelve months before the claim. We are not liable for lost profits, lost revenue, or lost or corrupted data, except where that loss was caused by our own gross negligence or wilful misconduct.

Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud.

Changes to these terms

We may update these terms. For material changes we will email account holders at least 30 days before they take effect. If you do not accept a change, you may cancel before it applies and we will refund any unused prepaid time on affected services.

Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Disputes go to the courts of British Columbia, though we would much rather you talked to us first — nearly everything is faster to resolve that way.
